Docket 21-328

Morgan v. Sundance, Inc.

Robyn Morgan sued Sundance for overtime pay violations, and Sundance delayed asserting its right to arbitrate the claims. The Supreme Court ruled that federal courts cannot create special rules requiring a party to show they were prejudiced by such a delay in order to prove the right to arbitrate was waived.
